Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Enserve, a platform operated by [LEGAL ENTITY NAME], a company registered in Nepal (Company Registration No. [OCR REG. NO.], PAN/VAT [PAN/VAT NO.], registered office at [REGISTERED OFFICE ADDRESS, MUNICIPALITY, DISTRICT, Nepal]). By creating an account or submitting a service request you agree to be bound by these Terms. If you don’t agree, please don’t use the service.

1. The service

Enserve is a platform that lets you submit, track, and pay for service requests across multiple institutions through a single account. We act as the conduit between you and the issuing institution — we don’t issue the document, licence, or approval ourselves, and we don’t control the institution’s decision or timeline.

2. Electronic acceptance

You agree that your electronic acceptance of these Terms, and the records and communications generated through the platform, are valid and enforceable under the Electronic Transactions Act, 2063 (2008) of Nepal.

3. Your account

• You must be at least 18 years old to create an account.
• You’re responsible for keeping your sign-in credentials secure. Notify us immediately at mail@enservehq.com if you suspect unauthorised access.
• One account per person. Don’t share it.
• Provide accurate information — falsifying identity or document data is grounds for immediate termination and may be reported to the issuing institution and relevant authorities.

4. Acceptable use

You agree not to:

• Use the platform for any unlawful purpose under Nepali law.
• Submit applications on behalf of another person without their explicit authorisation.
• Upload malware, scrape data, or attempt to disrupt the service.
• Reverse-engineer or interfere with platform security.
• Harass our staff or other users.

5. Fees and payments

Service-request fees are set by the issuing institution and disclosed before you submit. Enserve may charge a separate platform fee, also disclosed up-front. All fees are shown in Nepalese Rupees (NPR). Cancellations and refunds are governed by our Refund & Cancellation Policy and by the Consumer Protection Act, 2075 (2018).

6. Processing times

Estimated processing times shown in the catalogue are provided by the issuing institution and are not guaranteed. Enserve is not responsible for delays caused by the institution.

7. Intellectual property

The Enserve platform, brand, design, and code are owned by us. You receive a limited, non-exclusive, non-transferable licence to use the platform for its intended purpose. You retain ownership of the personal data you submit.

8. Privacy

Our Privacy Policy explains how we handle your data under the Individual Privacy Act, 2075, and forms part of these Terms.

9. Disclaimers

The service is provided “as is”. We make no warranty that it will be uninterrupted or error-free, or that requests submitted through it will be approved by the issuing institution. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for purpose, and non-infringement. Nothing in these Terms limits any right you have that cannot be limited under the Consumer Protection Act, 2075.

10. Limitation of liability

To the maximum extent permitted by law, Enserve’s total liability arising out of or in connection with these Terms or the service shall not exceed the total amount you paid us (excluding institution fees) in the twelve months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages.

11. Termination

You can close your account at any time by emailing mail@enservehq.com from the address on your account; we will process the closure and any associated data deletion in line with our Privacy Policy. We may suspend or terminate accounts that breach these Terms, after notice where reasonably practicable. Termination does not affect requests already in progress with an issuing institution.

12. Changes

We may update these Terms. Material changes will be notified by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the new Terms.

13. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of Nepal. Any dispute arising out of or relating to these Terms or the service shall be subject to the exclusive jurisdiction of the courts of [DISTRICT, e.g. Kathmandu], Nepal.
